实质性适用范围
Abs. 1
This Regulation applies to the processing of personal data wholly or partly by automated means and to the processing other than by automated means of personal data which form part of a filing system or are intended to form part of a filing system.
本条例适用于全部或部分以自动化方式对个人数据的处理，以及对构成或拟构成结构化档案系统一部分的个人数据以非自动化方式进行的处理。
Abs. 2
This Regulation does not apply to the processing of personal data:
本条例不适用于以下个人数据处理活动：
lit. a
in the course of an activity which falls outside the scope of Union law;
不属于欧盟法律范围的活动中进行的处理；
lit. b
by the Member States when carrying out activities which fall within the scope of Chapter 2 of Title V of the TEU;
成员国开展的属于《欧盟条约》第五编第二章范围内的活动；
lit. c
by a natural person in the course of a purely personal or household activity;
自然人在纯粹个人或家庭活动中进行的处理；
lit. d
by competent authorities for the purposes of the prevention, investigation, detection or prosecution of criminal offences.
主管机关为预防、调查、侦查或起诉刑事犯罪而进行的处理。
